H1B VISA
The H1 visa is a temporary worker's visa for specialty occupations. To obtain an H visa a person must be offered a position by a US employer. The US employer is required to apply to USCIS for the applicants H visa. Normally a person must have a BS or BA degree in to obtain an H visa thought there are exceptions. An H visa gives a person the right to work a specific job for a specific employer. If the visa holder wants to change employers, change positions, or get an additional job they must apply for another H visa. The H visa status may be obtained for up to three years and may be renewed for up to a second three year period, or a total maximum of six years. H4 visa is a visa for the dependents of an H1 visa holder. The H1 visa holder can apply for an H4 visa for their spouse and children. An H1 visa holder can not apply for an H4 for his or her parents.
K1 and K3 VISAS
The K1 visa is for the fiancé of a United States Citizen. K1 visas are granted to the fiancé of a USC if the fiancé lives outside the United States. USCIS regulations require that the USC and their fiancé have meet in person in the past 2 years. Normally if the USC and fiancé have not met in person within the past 2 years the K1 visa application will be denied. The fiancé visa holder must marry the United States Citizen within 3 months of entering the United States. A USC can file a K3 visa for their spouse living outside the United States. A Lawful Permanent Resident can not apply for a K1 visa for a fiancé.
L VISA
The L1 visa is a visa to transfer an employee of a company that operates in the US and abroad to the US operation. The employee can come to work in the US if they have worked for that employer outside the US for at least one year in the past 3 years. To be eligible for an L visa the employer must be a manager/executive or have specialized knowledge required by the company. Executives/managers receive an L1A visa and can stay in the US up to 7 years. Employees with specialized knowledge receive L1B visas and can stay in the US 5 years.
TN VISA
The TN visas is for professionals who are citizens of Canada and Mexico. They may work in the U.S. if their profession is on the NAFTA list and they are sponsored by a US Employer. The requirements for applying for citizens of Canada and Mexico are different. A TN visa holder can obtain a TD visa for their spouse and children. They can not obtain a TD visa for their parents. TD visa holders can not work in the United States. B1/B2 extensions maybe available to anyone who is in the United States on an unexpired B1/B2 visa who has a legitimate reason to remain in the US past the date on their I-94. A person can only be granted one B1/B2 extension and the entire period of their stay can not be longer than 1 year. B1/B2 extensions take several month so it is very important to apply for a B1/B2 3-4 months before the expiration date on your I-94.
R VISA
An R visa is for religious works to enter to US in the capacity as a religious work. This requires the US employer to be a 501(c)(3) Corporation.
